Pedestrian Fatally Struck in Brooklyn Crosswalk Accident

Pedestrian Accident AttorneyMark Schumaker, 36, was struck and killed by a vehicle on Linden Boulevard the afternoon of March 18 as he was walking in a marked crosswalk, Patch.com reports. Police officials responded to a 911 call of a pedestrian accident at Linden Boulevard and Ashford Street. A preliminary investigation showed that Schumaker was crossing the street when he was hit by a sedan traveling east on Linden Boulevard.

The victim was rushed to a local hospital where he was pronounced dead. The driver remained at the scene when police arrived and so far, no charges have been reported. The investigation is ongoing. Our deepest condolences go out to the family members of Mark Schumaker for their tragic loss.

Dangerous Intersection for Pedestrians

According to Patch, the major intersection where this fatal pedestrian accident occurred was fitted with pedestrian marking upgrades and median tip extensions in 2020, although the same intersection has reported 17 crashes in the last year, with seven pedestrian and 15 motorist injuries. In the last decade since the city’s Vision Zero initiative, two pedestrians have died at the intersection with 96 crashes reported at the intersection. During that period, the crashes at this intersection also resulted in injuries to 24 pedestrians, five bicyclists and 122 motorists.

Linden Boulevard was designated as a “priority corridor” in 2023 for pedestrian safety improvements after it was initially given the title during the De Blasio administration, Patch reports. This corridor is reportedly one of the deadliest for pedestrians based on deaths or severe injuries per mile, according to a report from last year.

In New York City, crosswalk laws are in place to ensure the safety of pedestrians and regulate the flow of traffic. According to New York State law, drivers must yield the right-of-way to pedestrians crossing the roadway within a marked or unmarked crosswalk at an intersection. This means that vehicles must come to a complete stop if necessary to allow pedestrians to safely cross the street.

Increased speed and negligent driving can put pedestrians at risk of serious injuries including head trauma, spinal cord damage, internal injuries, fractures, etc. Many of these injuries can also become fatal for pedestrians. Studies have repeatedly shown that the higher the speed of a vehicle while striking a pedestrian, the greater the injury.

Compensation for Victims

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
