A child was raped due to inadequate security controls in the Bronx building she lived in. We contended that the high-rise apartment complex in Harlem and its managing agent had inadequate control of master keys that controlled the building elevators and subpar security. Three youths entered the elevator, in which our client was riding, and used a copy of the elevator passkey to send the elevator to the basement. They then dragged the girl to an adjoining building in the complex and into another elevator. They used the key again to send the elevator to a top floor and jam it while they raped her. The settlement was reached before trial and it resulted in a total payout of $2,500,000.
