$500,000 – Child Fractures Arm due to Daycare Negligence

Sade Hill, a 3-year-old child, was pushed off of a playground apparatus by another child, fell, and fractured her arm. She was at a daycare program operated by a church, and the negligent, inadequate supervision of the staff lead to this accident. This was a difficult case as it was against a religious institution and it is difficult, if not impossible, to base a case on a 3-year-old’s testimony. However, we rejected offers by the church of $75,000; $125,000; $300,000; and just prior to trial, we pressed the defendants to pay 100% of their $500,000 insurance policy.
