A recent case that Kenneth A. Wilhelm settled was an auto accident case in which the injured lady lost her twelve- to thirteen-week-old fetus. In this kind of a case, New York state law says that only the money loss to the survivors can be obtained. Of course, a fetus is obviously not employed and is unable to produce any income, and therefore, the amount that can be recovered for the loss of the fetus is strictly reduced. In spite of the above circumstances, Mr. Wilhelm was able to settle the case for $350,000.
The mother who lost the fetus was a passenger in a car and was seat-belted at the time of the accident.
