A child was injured while on a motor scooter and suffered a broken leg. He was struck by a van while riding a motor scooter on the sidewalk. The child was crossing a construction yard’s driveway at the time of the accident. The van left the yard and struck the child on its way to the street. The child’s orthopedic surgeon testified that he would always have a permanent partial disability – including a limp – and that the external rotation of the boy’s left lower extremity was limited. The defense argued that the child did not have a limp and the bend in his thigh bone would get better as the boy matured. This case was tried and the result was a favorable verdict for $2,000,000.
