Medical Malpractice in the Emergency Room

Emergency Room Emergency rooms can be congested and chaotic. Physicians have to deal with a wide range of injuries and illnesses in a short amount of time. These types of pressure-filled situations can lead to serious medical errors. Emergency room doctors, nurses and staff still have a legal obligation to provide quality care to their patients. Doctors and hospitals can still be held liable for errors related to diagnosis and treatment in the emergency room.

Medical Malpractice Lawsuits
In order to hold a doctor or hospital accountable for errors that were made in an emergency room, a patient must prove that: there was a patient/doctor relationship, the emergency room treatment involved negligence and that the emergency room negligence was harmful to the patient. Proving that a doctor/patient relationship existed is perhaps the easiest element of any medical malpractice case. Once a doctor examines a patient or provides treatment, a doctor/patient relationship is established.
Proving negligence, however, can be more difficult. There are several questions that must be answered. Did the doctor act outside the realm of professional behavior? Were proper tests performed? Were obvious symptoms ignored or misdiagnosed? Was the level of care given to the patient below the appropriate “standard of care” under the circumstances?
Next, it is important to establish the injuries, damages and losses sustained by the victim as the result of such medical negligence. Did the victim experience pain and suffering because of the errors made by the doctor? Were additional medical bills incurred because of the negligence? Did the victim lose wages, earning capacity or the ability to enjoy life? These are all losses that should be considered during the claim process, along with any permanent injuries that were caused by the medical malpractice.
