A large chunk of facade tumbled from a Tribeca high-rise across the street from the Department of Buildings headquarters the morning of April 27. According to a Gothamist news report, the 30-foot chunk of rubble fell from 291 Broadway, a 19-story building undergoing facade repairs and surrounded by scaffolding and netting. Thankfully, no one was injured.
Site Has an Open Violation for Danger of Falling Debris
A buildings department spokesperson said the decorative stone had fallen from between the 15th and 16th floors. Officials said the debris was so heavy that it cut holes in the netting and knocked off part of a wooden awning on top of the scaffolding. It landed in a crosswalk and bike lane on Reade Street.
Building department records show the site was hit with a violation of the buildings code on March 11 for failure to secure the netting around the building. A DOB spokesperson confirmed to the Gothamist that the violation “a major concern for falling objects construction debris material creating possible hazard situation,” remains open. DOB’s headquarters is right across the street from this job site.
Danger of Falling Construction Debris in NYC
Falling debris from construction sites in New York City presents a serious and often deadly danger, not only to workers but also to pedestrians. In dense urban areas, materials such as glass, wood, scaffolding or tools can fall from heights due to wind, poor securing, equipment failure, etc. Even small objects can become lethal when dropped from tall buildings, and larger structural collapses can cause catastrophic injuries and fatalities.
Over the past decade, several tragic incidents have involved passersby being struck and killed by falling debris in New York. In 2015, a pedestrian in Greenwich Village died after a piece of plywood was dislodged by strong winds from a construction site and struck her while she was walking on the sidewalk. In 2018, a security guard was killed when a falling glass panel dropped from a Midtown high-rise construction project, highlighting the risks posed by facade work. More recently, in December 2025, a 75-year-old woman in East Harlem was killed when a chain-reaction vehicle crash caused scaffolding to collapse onto her as she stood beneath it.
These incidents are not isolated. Data has shown that, historically, construction activity in New York City injures roughly one passerby per month, demonstrating the ongoing risk to the public. Such fatalities underscore the importance of enforcing safety measures, including properly secured materials, protective sidewalk sheds and rigorous enforcement of building regulations to prevent avoidable tragedies.
Who is Liable for Facade Accidents?
Liability for facade-related accidents in New York City typically depends on who controlled the property and whether safety laws were followed. Property owners/managers are usually the primary responsible parties because they have a duty to maintain buildings in a safe condition. Under local requirements such as the New York City Facade Inspection and Safety Program (FISP), owners/managers must regularly inspect exterior walls and repair hazardous conditions. Failure to do so can make them liable if falling debris injures someone.
Contractors, subcontractors and construction managers, among others, may also share liability if negligence (carelessness) such as improper installation, inadequate securing of materials, or safety violations, contributed to the accident. In such cases, multiple parties can be held liable. An experienced New York City construction accident attorney can help injured victims and their families secure maximum monetary compensation for their losses.
