Cancer misdiagnosis is a form of medical malpractice and occurs more commonly than we know. According to a December 1999 study of 6,171 pathology test slides in Johns Hopkins Hospital in Baltimore, researchers found a 1.4 percent error rate. This research was done specifically on tests relating to cancer patients. Of the 86 total cases of misdiagnosis, 20 had benign tumors misdiagnosed as malignant causing those patients to receive unnecessary cancer treatment. An earlier study of prostate cancer biopsies at Johns Hopkins found an error that ruled out cancer in six out of 535 cases. There is no question that cancer misdiagnosis can have devastating consequences – both, physically and emotionally – on a patient.
A recent case in the Ohio courts involved a 73-year-old woman who sued her physician for misdiagnosing breast cancer. The woman said her doctor failed to detect a breast mass, causing her to endure more invasive treatment and mental anguish. That state’s Supreme Court recently ruled the woman could pursue damages for emotional distress in her case.
