dump truckA female construction worker was run over by a dump truck being operated by a co-worker. According to The Morning Call, new details were released in the construction site accident involving a 43-year-old worker, which occurred in April. The woman was working on a roadside project when a 51-year-old co-worker driving a Ford F-650 dump truck backed into her. She was hit by the passenger side rear bumper and then got pulled under the truck. Her co-worker did not realize he had hit her until other workers on the job site got his attention. It is not yet known why the victim did not hear the dump truck backing up. Investigators are looking into whether or not the truck was equipped with the proper reverse beeping sound safety measure. The Occupational Safety and Health Administration (OSHA) is investigating the accident. Our law firm achieved a $2,000,000 verdict for a boy who was injured by a truck with no beeping sound safety measure.
The New York City Department of Buildings reported that there were 157 construction accidents in 2010, of which four were fatal. Construction sites are, of course, inherently dangerous. However, a number of injury accidents that occur at construction and other worksites are entirely preventable. Some common accidents on construction sites include falls from elevated heights, electrocution, falling objects, machinery malfunction and slip-and-fall accidents. About 19 percent of all construction site accidents are the result of some kind of contact with objects or equipment.
Workplace accidents may occur due to a variety of reasons. In some cases negligence by another employee may result in an injury accident. In other instances, a machinery defect or malfunction could contribute to an accident. It is the employer’s responsibility to make sure that all employees are adequately trained and that the equipment being used is safe.
In addition to workers’ compensation benefits, injured workers or families of deceased workers may be able to claim compensation by filing a third-party claim. Examples of third parties include, but are not limited to, general contractors, sub-contractors, building owners, manufacturers of defective products, etc.
