A 55-year-old man suffered a fatal head injury in a New York motorcycle accident, ironically, as he was protesting helmet laws. According to a news report in The Herald Sun, the fatal motorcycle accident occurred in Onondaga, a town near Syracuse. The man was riding his 1983 Harley-Davidson without a helmet, when he hit his brakes and lost control. He flipped over his handlebars and suffered a fatal head injury. He was pronounced dead on arrival at the hospital. Authorities say this tragic motorcycle accident may not have been fatal, had the motorcyclist been wearing a helmet.
Motorcycle groups throughout the country fight to repeal helmet laws although evidence shows that helmets do save lives and greatly reduce the chances of a catastrophic brain injury. According to the Governors Highway Safety Association (GHSA), wearing a proper helmet can decrease the chances of being killed in a motorcycle accident by more than 40 percent.
Helmets are crucial in preventing catastrophic head injuries and New York officials do their part to enforce helmet regulations. Under New York law, it is unlawful for any person to operate or ride a motorcycle unless he wears a protective helmet. Bicyclists under the age of 14 must also wear a helmet while riding in New York.
Of course, helmets cannot prevent every catastrophic head injury. In cases where negligence or wrongdoing is involved, victims of catastrophic head injuries may pursue financial compensation for their losses by filing a personal injury claim against the at-fault motorists. Damages that may be covered in a civil lawsuit include, but are not limited to past and future pain and suffering, lost wages and benefits, and medical expenses.
