1-year-old New Jersey Boy Critically Injured after Fall from Window

Fall from windowA 1-year-old boy is in critical but stable condition after he fell out of a third-floor window in his New Jersey home, WABC reports. The child’s father told police that he was in his Jersey City apartment on Union Street, cooking in the kitchen, when his 1-year-old son fell out of their bedroom window. The child seemed limp and lifeless as paramedics took him to the hospital, neighbors said. Investigators said the boy had dried blood under his arm and bruising on his side and injuries to his head, spleen and lungs. The child was rushed to an area hospital. The investigation is ongoing.

Falls from Windows
The American Academy of Pediatrics estimates that about 5,100 children are injured each year as a result of falling from windows. Between the years 1990 and 2008, 98,415 children were treated for injuries caused by window falls. A study by the organization showed that children under the age of 5 were most likely to suffer serious injuries such as brain damage. The extent of the injuries usually depended on the height of the window and the type of landing surface. For example, children who landed on a hard surface such as concrete were twice as likely to suffer head injuries or require hospitalization compared to those who landed on a softer surface such as grass.
Window Guard Law
New York’s window guard law, which was signed by Mayor Mike Bloomberg in September 2011, required property owners to send an annual notice to tenants of multiple dwelling (building with three or more apartments) regarding window guards. It also required owners to provide and properly install approved window guards on all windows including first floor bathrooms and windows leading onto a balcony or terrace in an apartment where a child 10 years of age or younger resides.
The landlord must install the window guards even when young children do not live in the apartment, if the tenant requests it in writing. For example, grandparents who have children visiting them from time to time or parents who share custody may wish to have window guards installed.
