A 63-year-old woman accused of driving while intoxicated made a left-hand turn without yielding the right-of-way and crashed into another car. According to Patch.com, the woman was driving her 2010 Chevrolet Malibu northbound on Route 22 when she tried to make a left turn into a gas station. Officials say  she failed to yield the right-of-way to oncoming traffic as she hit a 1998 Honda Civic driven by a 57-year-old man. The man sustained fractured ribs and was taken to Putnam Hospital Center.
The woman said she was experiencing pain in one of her arms but did not seek medical attention. Police stated that as they were conducting their investigation, they could smell alcohol on the woman’s breath. Officers gave her a sobriety test, which she failed. The woman was determined to have had a blood alcohol concentration of 0.15 percent – nearly twice the legal limit of 0.08 percent. She has been charged with driving while intoxicated. Officials say she has a prior DUI conviction.
According to the New York State Department of Motor Vehicles (DMV), there were 8,613 alcohol-related car accidents in the state in 2010. Of those, 327 were fatal and 4,445 resulted in injuries. The DMV reports that a person driving with a blood alcohol level of .08 is four times more likely to cause an accident. A driver with a blood alcohol content of .16 is 25 times more likely to cause a crash.
Victims of an impaired driver may choose to pursue a case in civil court, whether or not criminal charges are filed against the driver. Often, victims of these types of accidents undergo significant financial and emotional distress. They incur medical expenses, hospitalization costs and frequently end up paying out of pocket for physical therapy and other rehabilitative treatment.
