A worker was injured in a Brooklyn elevator accident on Feb. 9, officials said. According to CBS New York, officials said the accident took place when an elevator mechanic was working on a merchandise lift and a cable supporting the elevator failed. That caused the lift to fall 15 feet with the worker trapped inside. Firefighters and paramedics who came to the scene, extricated the worker from the elevator shaft and transported him to Elmhurst Hospital. The U.S. Occupational Safety and Health Administration (OSHA) is investigating the incident. Our thoughts and prayers are with the injured worker and we wish him the very best for a speedy and complete recovery.
Elevator Accidents Involving Cable Failure
Elevator accidents involving cable failure, while rare, can cause significant injuries and damage. Modern elevators are designed with multiple steel hoist cables, and each cable is capable of supporting the full weight of the elevator car. This redundancy greatly reduces the risk of a complete system failure. In addition, elevators are equipped with advanced safety devices such as overspeed governors and automatic braking systems that engage if the car moves too quickly or if tension in the cables is suddenly lost.
However, factors such as corrosion, metal fatigue, poor lubrication or lack of routine inspection may contribute to the cable weakening over time. Most elevator-related injuries are more commonly associated with door malfunctions, mis-leveling between floors or maintenance errors. Regular inspections, adherence to building codes, and proper servicing by certified technicians are essential when it comes to elevator safety.
Injuries from Elevator Cable Failure Accidents
The severity of a victim’s injuries often depends on factors such as the speed of the elevator’s drop, the distance traveled before stopping and whether safety systems functioned properly, etc. When cable failure occurs, passengers may experience sudden drops or abrupt stops. These rapid movements can lead to serious physical injuries.
Common injuries include fractures, sprains and bruises caused by passengers losing balance during a sudden jolt. Head injuries and concussions may occur if individuals strike walls, floors or handrails. In more severe cases, spinal injuries can result from the force of impact when the elevator stops suddenly. Psychological effects such as anxiety or post-traumatic stress may also develop after such incidents.
Your Rights After an Elevator Accident
New York law requires property owners/managers to maintain elevators in safe working order. If negligence (carelessness) caused the accident, you will have grounds for a personal injury claim. Possible compensation includes, but is not limited to, medical expenses, lost wages and benefits, hospitalization and rehabilitation costs, past and future pain and suffering, etc. Families of victims of fatal elevator accidents may also bring wrongful death claims.
Elevator accident cases can be complex, often involving multiple parties and technical details. An experienced New York City personal injury lawyer can help investigate the accident and obtain inspection records; work with engineering and elevator experts to establish fault; handle communication with insurance companies; and negotiate settlements or take the case to trial.
Compensation for Injured Workers
When a worker is injured on the job, the first line of financial protection is usually workers’ compensation. This system provides benefits regardless of fault, covering medical expenses, some lost wages and rehabilitation costs. In cases of permanent disability, workers’ compensation may also provide long-term or lifetime benefits. However, workers’ compensation does not cover pain and suffering and benefits are often limited compared to the full extent of losses. The large verdicts and settlements occur when others are sued in third-party cases.
In some situations, injured workers may also pursue a third-party lawsuit in addition to workers’ compensation. These claims arise when someone other than the employer or co-employees — such as a subcontractor, equipment manufacturer, or property owner and manager — contributed to the accident. For example, if a defective elevator caused injuries and damages, the manufacturer may be held liable. Third-party lawsuits can provide compensation for damages not covered by workers’ compensation, including pain and suffering, emotional distress and full lost earnings, and again the big verdicts are against the THIRD PARTIES.
