A woman was awarded $3.9 million after a doctor misdiagnosed a brain bleed as a migraine — a mistake that led to the woman’s paralysis. According to Coloradoan.com, the 39-year-old woman suffered a hemorrhagic stroke in 2006 after an emergency room doctor sent her home with migraine medication when her brain was actually bleeding. The woman went to the hospital and complained of a severe headache and it was found she also had very high blood pressure. The woman said she woke up the next morning and that her headache was gone, but she could not walk or talk. It was later determined that she had a brain bleed that was misdiagnosed as a migraine. She was taken back to the hospital for treatment. The woman spent the first month after the stroke in a wheelchair and she is still paralyzed on the right side of her body.
According to the Journal of the American Medical Association (JAMA), more than 225,000 people die every year because of medical errors. There are about 12,000 deaths a year because of unnecessary surgery, another 80,000 because of infections contracted in hospitals and about 7,000 because of a medication error.
While medical negligence cases are commonly considered to involve errors in treatment by doctors or other medical professionals, that is not always the case. Diagnosing a patient properly is just as important as performing a procedure. Overlooking a potentially serious condition can be life altering for a patient and devastating to the patient’s family.
Medical malpractice also covers a variety of other areas such as mistakes in surgery or improperly prescribing medications to patients. In some cases, it can mean that the patient will have to undergo more unnecessary surgery to correct the error. In the worst cases, these errors could become fatal. Victims of medical malpractice may be entitled to compensation such as lost wages and benefits, past and future pain and suffering, hospitalization costs, physical therapy, etc.
