Police in Brooklyn have arrested four teens who forcibly entered an apartment, tied up a couple, ransacked their home and sexually assaulted the woman. According to a report in the New York Daily News, the incident occurred in a Bedford-Stuyvesant apartment, when the alleged gang members between 13 and 18 years old attacked the couple. Officials say one of the suspects went to get cash with stolen ATM cards, while the three other teens repeatedly forced the 22-year-old female victim to perform oral sex, threatening to kill her if she refused. She was also sodomized and fondled numerous times, officials say. Prosecutors say all the defendants confessed to the crimes.
Rape is defined as non-consensual sexual intercourse committed by physical force, threat, injury or some other type of intimidation. According to the New York State’s Division of Criminal Justice Services, there were 2,761 forcible rape cases in New York State compared to 2,572 in 2009 – which depicts a 7.3 percent increase.
There are many different types of sexual assault and several different circumstances under which they may occur. However, if an assault occurs on a property such as an apartment complex or a parking lot as a result of poor security, lighting or inadequate surveillance, then the victim can hold the property owner and/or manager civilly liable for the incident. In some cases, the assailants may enter apartment units because the locks on the doors may be defective or ineffective. It is a property owner’s duty and responsibility to make the premises safe not only for residents and tenants, but also visitors.
In some cases, a victim may also have a case against an organization where the person who committed the sexual abuse was employed. Damages can be recovered if the organization did not do its due diligence in terms of hiring the individual or if members of the organization knew that the victim was in a vulnerable state, but did nothing about it. Organizations or institutions that deal with children in particular must ensure they take the necessary steps to prevent sexual abuse.
