A woman was seriously injured in a pedestrian accident in Midtown Manhattan after being struck and pinned by a livery cab, ABC7 reported. According to the news report, the incident occurred at the intersection of 2nd Avenue and East 50th Street in Midtown. Officials said a group of good Samaritans rushed to help the victim, banding together to lift the vehicle off the trapped women. Witnesses say although she was bleeding and mostly unconscious, the 57-year-old victim was able to squeeze a finger on one of her rescuers.
Ongoing Investigation
One witness said a group of people used jacks to try and lift the car and provide help to the trapped victim. He said by the time they lifted the vehicle off the woman, she was moving her feet and ankles. The victim was transported to an area hospital where she is said to be recovering.
The livery cab driver, who struck her, remained at the scene. He was questioned by police. There are not many details of how the pedestrian accident occurred. So far, no arrests have been made. The investigation is ongoing. Our thoughts and prayers are with the injured victim.
Pedestrian Accidents and Negligence
The Governors Highway Safety Association (GHSA), in a recent report, estimated that 6,590
pedestrians were killed in car accidents last year, amounting to a nearly 5% increase from the 6,283 deaths in 2018. This is the highest that pedestrian accident fatalities have been nationwide in the last 30 years. The number of pedestrian fatalities has increased by more than 50 percent – from 4,109 in 2009 through 2018. Still, the total number of all other types of traffic accident deaths went up by only 2% in that period, the report states.
Also, according to data, distracted drivers and/or inattentive drivers are the leading cause of pedestrian accidents in New York City and over 15,000 collisions can be attributed to this problem annually. As New York injury attorneys, we see a large number of these types of pedestrian versus vehicle collisions resulting from factors that include drivers who were just not paying attention to the road ahead, the street intersection, pedestrians in front of them, or a crosswalk, etc. Another factor here is a driver’s failure to yield the right of way.
In pedestrian accident cases where negligence (carelessness) is established, drivers and their employers and other responsible parties can be held financially liable for the injuries, damages and losses they cause, even if the authorities don’t file criminal charges against them. Injured victims will able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones may be able to file a wrongful death lawsuit against the at-fault parties seeking compensation for damages as well.
It is important to remember that pedestrian accident victims and their families may be able to seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver has not been charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
