pedestrian A marketing executive was crushed to death in a pedestrian accident involving a dump truck. The fatal injury incident occurred as the victim was struck while crossing 11th Avenue near West 37th Street on her way to the Javits Convention Center for a toy fair. According to a report in the New York Post, the 48-year-old woman was going to the venue to set up for a four-day toy expo when the dump truck hit her. The truck driver was turning from West 37th onto 11th Street and may not have seen the victim crossing, witnesses said. The truck driver has been arrested and charged with failure to yield to a pedestrian.

NYC Pedestrian Accidents
Even as the de Blasio Administration is attempting to crack down on traffic accident fatalities, especially pedestrian accidents in New York City, the number of pedestrian deaths continues to remain high. According to preliminary data, there have been 197 traffic deaths in 2015 of which 109 were pedestrians. In 2014, there were 228 traffic deaths including 121 pedestrians. NYPD has also sought to crack down on dangerous and reckless driving by deploying more officers in the streets and in an attempt to enforce speed limits and rules regarding yielding to pedestrians, distracted driving and parking in traffic lanes.
According to the New York Vehicle and Traffic Law Section 1151 (a): “When
traffic-control signals are not in place or not in operation the driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk on the roadway upon which the vehicle is traveling, except that any pedestrian crossing a roadway at a point where a pedestrian tunnel or overpass has been provided shall yield the right of way to all vehicles.”
Failure to Yield
Some of the deadliest pedestrian accidents occur in crosswalks and at street intersections. Failure to yield the right of way to pedestrians is one of the most common causes of vehicle versus pedestrian accidents in crosswalks, intersections and parking lot entrances and exits. A driver may fail to see a pedestrian who is crossing at an intersection because of impairment, inattention or distraction. When this occurs, the at-fault driver can be held liable for the injuries, damages and losses caused. Some of the common injuries suffered in these types of accidents include traumatic brain injury, spinal cord damage, broken bones, internal organ damage, etc.
If You Have Been Injured
If you have been injured in a New York City pedestrian accident, there are a number of steps you can take to help protect your rights. First, make sure you file a police report and obtain a copy. Note down as many details of the accident as possible. Write down everything you remember. Take photographs of the accident, the position of the vehicles and images of your injuries. Preserve all physical evidence such as torn or bloody clothing. Be sure to get prompt medical attention regardless of how minor you think your injuries may be. Never admit fault or make statements to an insurance company that may be used against you. After a pedestrian accident, there are many injuries such as neck trauma or internal organ injuries that may not surface until later. Document your injuries and other expenses you have incurred as a result of your accident. Get contact information for others involved in the collision as well as phone numbers or e-mail addresses for eyewitnesses. Contact an experienced New York City pedestrian accident lawyer who can help ensure that your best interests are protected.
Compensation for Injured Pedestrians
Pedestrian accidents often cause severe injuries that may have a long-term or even lifelong impact on victims and their families. Injured victims of pedestrian accidents can seek compensation from the at-fault motorist for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injury, disability, loss of livelihood, past and future pain and suffering, etc. Families of deceased victims can file a wrongful death claim seeking compensation for damages as well.
