A 54-year-old sheriff’s deputy has been killed in a New York car accident involving a rear-end collision between her bicycle and a car. According to The Seattle Press Intelligencer, the fatal bicycle accident occurred in Irondequoit. The deputy was riding her bike when she crashed into the back of a vehicle that was making a turn. She died from her injuries, a day after the collision, in a nearby hospital. It is not clear what caused the tragic collision.
The New York State Department of Motor Vehicles reported 5,620 bicycle accidents in the year 2009. During that same year there were 30 fatalities and 5,560 injuries reported as a result of New York bicycle accidents. About 67 percent of all New York bicycle accidents resulted from factors such as distracted driving, failure to yield the right-of-way or an error made by the bicyclist. Anytime someone is killed in a New York bike crash, it must be determined what lead to the collision. Did the car driver turn in front of the bicyclist without yielding right-of- way? Was the car’s driver distracted at the time of the crash? Did the motorist fail to use turn signals? Did alcohol play a part? These are all important questions to ask in the aftermath of a fatal accident.
Negligent car drivers may be held liable for the damages they cause. The family of a victim killed in a New York bicycle accident may file a wrongful death claim against an at-fault driver to seek compensation for their irreparable loss. Damages that may be recovered include, but are not limited to medical and funeral expenses, and lost future income and benefits.
