Pedestrian Killed in Manhattan Hit-and-Run Crash

A 52-year-old man was struck and killed in a pedestrian accident, which officials said involved a hit-and-run driver. According to a WABC news report, the fatal collision occurred early morning on Dec. 12 at the intersection of 110th Street and 3rd Avenue in Harlem. Police say the pedestrian was crossing the road when he was hit. The driver eventually lost control of the vehicle, which flipped over about two blocks from the scene of the fatal pedestrian collision. The driver then fled the scene.

According to at least one eyewitness, the driver of the vehicle that hit the pedestrian was driving erratically. Witnesses said the driver was speeding and running red lights moments before the crash. The victim’s family said he was on his way home after working the night shift when he was struck. His life partner told the media that she just wants justice for the death of her loved one and wants to see the driver held accountable. Our deepest condolences go out to the family members of the deceased victim.

What to Do After a Hit-and-Run Crash?

If you are a pedestrian who has been injured in a hit-and-run crash, it is important that you get prompt medical attention. It is a fact that pedestrians can experience serious injuries such as traumatic brain injuries, spinal cord trauma, multiple broken bones and internal injuries, even if the vehicle strikes him or her at a lower speed. The greater the speed, the more serious the injuries are likely to be for a pedestrian.

If you are able to do so, it is important to note down the car’s make, model and color. Ask witnesses if they can recall unique or identifying markers on the car such as decals, bumper stickers or dents. Even a partial license plate number can help identify the vehicle or driver. It can also be very helpful to collect evidence from the scene such as photos of debris left behind by the hit-and-run vehicle.

Take photographs of your injuries as well as the accident scene. If you are injured and need to get to a hospital right away, ask a family member or friend if they can assist you with gathering such crucial evidence. Your pedestrian accident lawyer can also help you obtain and compile evidence including getting a copy of the police report.

Seeking Compensation in Hit-and-Run Crashes

A vast majority of hit-and-run crashes are caused by negligent (careless) drivers who are speeding or violating the rules of the road. Such drivers can be held financially responsible for a crash and the injuries caused, whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household.

In such cases, the at-fault driver (when identified) may face charges and penalties. In addition, he or she can be held financially liable for the injuries, damages and losses caused. You should retain an experienced personal injury lawyer right away to help protect your legal rights. A family who has lost a loved one in a hit-and-run crash may be able to file a wrongful death lawsuit seeking compensation as well.
