A 63-year-old man was killed in a hit and run collision on Long Island, which officials said, involved a driver who fled the scene. According to a report in the New York Daily News, the pedestrian was crossing Jerusalem Avenue near Spencer Place in Hempstead. The driver sped off after striking the pedestrian. But, another motorist who saw the collision made a quick U-turn and flagged down a police officer nearby.
The officer was able to track down the driver and arrest him. The driver, who lives in Hempstead, was charged with leaving the scene of a fatal accident and unlicensed operation of a motor vehicle. The victim was transported to an area hospital where he died from his injuries. We offer our deepest condolences to the family of this deceased pedestrian for their tragic loss. Please keep them in your thoughts and prayers.
What Does the Law Say?
Under New York vehicle and traffic laws, leaving the scene of an injury or fatal collision is illegal. A driver who does so can face criminal charges. Under the law, motorists are required to stop immediately at the scene of the accident and remain at the scene until officials arrive. They are then required to cooperate with officials and exchange information such as driver’s license, insurance, contact information, etc. with other parties involved.
The law also states that motorists should stop and obtain help for injured victims. In such traffic accident cases, getting medical attention can make the difference between life and death. Also, when a motorist leaves a victim lying in the roadway, it exposes the victim to further injury, which may prove devastating.
Compensation for Victims and Families
If you or a loved one has been injured in a car crash where the driver fled the scene and has not been identified or found, it is important that you take a number of steps including filing a police report, gathering evidence from the scene and getting prompt medical attention, etc. You should also contact an experienced New York City hit-and-run lawyer immediately, so your rights and best interests can be protected and as there are many pitfalls in these cases.
A victim who has been injured by a hit-and-run driver can seek compensation through the uninsured motorist clause of his or her auto insurance policy even though the driver has not been identified or through a quasi-state agency if there is no motor vehicle in the victim’s household. It is important to remember that in cases where the injured victims are pedestrians, they may be able to seek compensation for injuries or losses in a collision even if they were not walking in a marked crosswalk.
Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her. A family who has lost a loved one in a hit-and-run crash may be able to file a wrongful death lawsuit seeking compensation as well.
