Off-Duty Nassau Police Officer Killed in DUI Collision

Patricia Espinosa, a 42-year-old off-duty Nassau County police officer, was killed in car accident after an alleged impaired driver ran a red light and struck Espinosa’s vehicle. According to a report in Newsday, the crash occurred early morning on Jan. 31. Suffolk police said Matthew Smith, 20, drove an SUV north on Alexander Avenue through a red light and struck Espinosa’s vehicle, which was heading west on Nesconset Highway near Smith Haven Mall.

Espinosa was reportedly on her way to work at the Fifth Precinct when the crash occurred, officials said. Smith has been charged with driving while intoxicated. He and a 25-year-old passenger were taken to Stony Brook University Hospital with non-life-threatening injuries, police said. We offer our deepest condolences to the family of Patricia Espinosa, her co-workers and community for their tragic and heartbreaking loss. They will be in our prayers.

The Dangers of Impaired Driving

Alcohol impairs judgment, slows reaction time and reduces coordination, making it difficult for drivers to respond to hazards, obey traffic laws or accurately judge speed and distance. Even small amounts of alcohol can increase risk, especially at night or in bad weather.

Drunk driving accidents frequently cause serious injuries such as brain trauma, spinal damage, broken bones and internal bleeding. Victims may face lifelong disabilities, chronic pain or emotional trauma, while families suffer grief, financial strain and loss of stability. Innocent pedestrians, bicyclists and other drivers are often the ones harmed most in these incidents.

New York Laws and Victims’ Rights

In New York, driving under the influence (DUI) — formally called Driving While Intoxicated (DWI) — carries strict criminal penalties, especially when a crash causes personal injury. Operating a vehicle with a blood-alcohol concentration (BAC) of 0.08% or higher is illegal for adults. Lower limits apply to commercial drivers and drivers under 21. A first DWI offense can mean fines, possible jail time and license revocation with harsher penalties for repeat offenses or higher BAC levels. Courts also require ignition interlock devices after conviction to prevent restarting the vehicle without a breath test.

If a drunk driving crash injures someone, the consequences become significantly more serious. Beyond basic DWI charges, prosecutors can pursue vehicular assault or other felony charges if the impairment directly causes serious physical injury. This elevates the charge and increases potential prison sentences and fines. New York’s Leandra’s Law adds even stricter penalties in cases involving children in the vehicle, including felony charges and mandatory interlock devices.

Contacting an Experienced Lawyer

In addition to criminal charges, an intoxicated driver can also be held financially liable for injuries they cause. Injured victims of negligent (careless) drivers can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in car accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc. It is in the best interest of injured victims and their families in such cases to contact an experienced personal injury lawyer before contacting the people responsible for the injuries, and definitely before contacting or communicating with any insurance company, or their lawyers, investigators, or adjusters.
