Nineteen people were hospitalized following a New York bus accident that may have involved a speeding driver. According to a news report in the International Business Times, the bus accident occurred on Interstate 81 in Upstate New York. The bus was travelling in rain-slicked conditions when it left the roadway, went down an 80-foot embankment and overturned into a gully. Of the 30 occupants, 19 were hospitalized, including a woman who was pinned under the bus for an hour. Investigators believe the bus driver was traveling too fast given the wet conditions.
This is reportedly the third New York tour bus accident in three weeks. Two weeks ago, one person was killed and 30 were injured in a Seneca County bus accident involving a tractor-trailer. Days before that crash, two people were killed in a Steuben County bus accident when the bus blew a tire on the northbound Interstate 390.
According to New York Code – Section 1180: “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” This means that drivers, especially those who operate commercial vehicles carrying passengers, are responsible for staying within the speed limit as well as driving at a speed that is safe, given the traffic and roadway conditions. Speeding drivers put everyone on the roadway at risk. When the speeding driver is behind the wheel of a bus, there is the potential for the many passengers on board to suffer serious injuries.
Victims of New York bus accidents may seek financial compensation for their losses by filing a claim against the bus company, bus owner or the bus driver. Damages that may be covered include, but are not limited to medical expenses, past and future pain and suffering, and lost wages and benefits.
