Juries in the Bronx ruling on civil cases awarded $80 million in 2011 for various cases including medical malpractice, wrongful arrest, construction accidents, and car crashes, among other cases. According to the New York Daily News, more than 20,000 lawsuits were filed last year and 50 of those resulted in awards totaling $80 million.
Here are a few examples of plaintiffs who received favorable verdicts in 2011. A flooring worker received $18.6 million after a paint sealant he was using unexpectedly burst into flames. He suffered severe burn injuries as a result. A maintenance worker received $6 million for tripping at an apartment complex. The worker’s hand got wedged in a trash compactor. A woman won $2.5 million in a medical malpractice lawsuit after a doctor failed to diagnose appendicitis, nearly killing her. A 59-year-old man was awarded $2 million after a bus ran over him and crushed his legs.
There are a variety of scenarios in which victims of accidents may be able to file a lawsuit and pursue compensation for their injuries. These include workplace accidents, traffic accidents, and botched medical procedures. In workplace accidents, if an injury occurs because of employer negligence, the victim may have a case. Employers are required to ensure the workplace is safe and that the worker is properly trained on how to use an assigned piece of equipment or machinery. Employers must also provide workers with the necessary safety gear.
Whether you have been injured by a negligent driver, misdiagnosed by a doctor, or injured by a defective product, the civil justice system gives you an opportunity to not only seek compensation for your losses, but also to hold wrongdoers accountable. In cases where negligence is involved, injured victims can seek compensation for damages including, but not limited to, medical expenses, loss of wages and benefits, hospitalization, past and future pain and suffering, emotional distress, loss of consortium, etc.
