Elderly Woman Struck and Killed by Taxicab in Lower Manhattan

A woman was fatally hit by a yellow taxicab in downtown Manhattan the afternoon of May 18. According to an NBC news report, the pedestrian accident occurred at the intersection of Center and Broome streets. NYPD officials say the woman was walking in a marked crosswalk when the cab that was trying to make a left turn, struck her.
Officers found her lying in the roadway with severe head trauma. She was transported to a local hospital where she died from her injuries. The 44-year-old cab driver remained at the scene. Police said he was charged with failure to yield the right of way to a pedestrian and failure to exercise due care. The victim was about 80 years old. The investigation is ongoing. Our heartfelt condolences go out to the family of the woman who was killed in this pedestrian accident.

Failure to Yield to a Pedestrian

The most common cause of fatal or major injury pedestrian accidents in New York City is a driver’s failure to yield the right of way to a pedestrian. New York laws require motorists to come to a complete stop at crosswalks and yield the right of way until the pedestrians in the crosswalk have safely gotten across the roadway. Motorists are required to follow the posted speed limits at residential, school and commercial zones. This often helps motorists come to a stop or slow down if necessary when pedestrians are in the roadway.
These types of pedestrian accidents often occur when drivers are impaired, distracted, or simply careless or negligent. The nature and severity of injuries in such accidents usually depend on factors such as vehicle speed and the victim’s age and health. Older pedestrians are more likely to suffer major or fatal injuries when struck by a vehicle.

Rights of Pedestrian Accident Victims

In such cases, the at-fault driver and his or her employer can be held liable for the injuries, damages and losses caused. If the vehicle that struck a pedestrian is a taxicab, the owner, operator, etc. of the taxi company can also be held liable. There may be other parties who can be held accountable as well. An experienced New York City pedestrian accident lawyer will be able determine that. It is important that you protect your rights by filing a police report, gathering evidence from the scene, getting prompt medical attention and contacting a knowledgeable attorney who will fight to help you secure maximum compensation for your losses.
Injured victims of pedestrian accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
Please remember that you can file a personal injury lawsuit even if you were not walking in a crosswalk at the time of the collision. Our law firm has secured compensation for pedestrians who were not walking in a crosswalk when their injury crash occurred. We have recovered millions of dollars for pedestrians who were not in crosswalks.
