Construction site accidentA construction worker suffered injuries while using a jackhammer at a New York work site. According to a DNAinfo.com news report, the construction site accident occurred at 206 E. 61st Street in the Upper East Side. Officials say he was working on a townhouse when the jackhammer fell on his feet. He sustained serious injuries and was transported to a nearby medical center. It is unclear how the accident occurred or if the investigators with the Occupational Health and Safety Administration (OSHA) are looking into what caused the incident.
According to the New York City Department of Buildings, there were 128 construction accidents in the year 2011. Those accidents resulted in 152 construction-related injuries. Because of the many hazardous conditions on any given site, construction work is consistently near the top of most dangerous jobs. According to the 2010 Census of Fatal Occupational Injuries, there were 751 fatal construction accidents in the United States.
Ensuring Worker Safety
OSHA requires all employers to provide reasonably safe conditions for their workers. As a part of this requirement, OSHA requires employers to properly train employees. Employers must also provide adequate safety gear, proper supervision and equipment that has been properly maintained and inspected. There are many preventable construction accidents that result from an absence of proper safety measures on site.
Compensation for Injured Workers
Workers who are injured on the job are entitled to receive workers’ compensation benefits. Compensation should be available for medical bills and lost wages. In cases involving third-party negligence, additional compensation may be available for the victim or his or her family through civil litigation, against property owners, general and sub contractors, etc.
