Child Suffers Head Injuries after Fall from Window

windowfall A 2-year-old girl suffered head injuries after falling from the window of a home in Trenton, New Jersey. According to a report on NJ.com, the child fell asleep with family members and went missing at some point in the night. As family members looked around the home for the girl, a neighbor knocked on their door and said the girl was on the sidewalk. She had fallen from the window. The girl was transported to an area hospital. She suffered bleeding on the brain and a skull fracture. No other details were available about this incident. What the Numbers Show
Statistically, falls from windows increase dramatically during spring and summer months. These tragic incidents usually occur when young children push themselves against window screens or climb onto furniture located next to an open window. According to the U.S. Consumer Product Safety Commission (CPSC), falls from windows result in eight deaths annually involving children 5 and younger. An estimated 3,300 children, ages 5 and younger, are treated each year in U.S. hospital emergency departments as a result of window falls. On average, one out of every three children, about 34 percent, required hospitalization after falling from a window.
Property Owner’s Duty
Under New York City’s Health Code (S. 131.15), owners of multiple dwellings in New York City must provide, install, and maintain window guards when children 10 years or younger live there. Tenants with no children, or none living at home, may also request and receive window guards if they want them for any reason. Window guards approved by the NYC Department of Health (DOH) must be properly installed according to DOH specifications in all windows, including bathroom windows, except any window providing access to fire escapes. If a property owner or property manager is negligent in this regard, he or she can be held financially responsible for any accidents or injuries that occur due to the lack of a window guard.
