Brooklyn Companies Fined after Fatal Accident

The Occupational Safety and Health Administration (OSHA) cited three Brooklyn companies after a 22-year-old worker was fatally injured on the job. In January, the young worker was pulled into an unguarded mixer at a tortilla manufacturing company. A July 29, 2011 article by EHS today reports three tortilla manufacturers now face a total of 34 safety violations. OSHA reports that the company where the incident occurred failed to provide guards, didn’t have a lockout program to prevent a machine from starting up, failed to provide necessary training, and did not properly report the fatal accident when it occurred. OSHA investigators inspected and fined two other tortilla companies because of the concerns they had after examining the site of the fatal accident.
According to The Bureau of Labor Statistics, food manufacturing has one of the highest incidences of injury and illness among all industries. Seafood product preparation and packaging and dairy product manufacturing have the highest incidence of injury and illness among all food manufacturing industries.
Whenever an accident occurs at a manufacturing plant, it must be determined if the employer or property owner provided reasonably safe workplace conditions. As long as the victim was doing work-related activity at the time of the accident, compensation should be available through workers compensation insurance. An investigation is important to prevent future accidents and to determine if negligence was a factor in the accident. Compensation may be available for medical expenses, funeral costs, lost future income and benefits, emotional distress, past and future pain and suffering.
