A pedestrian has died from severe injuries suffered in a collision with a bicyclist in the Flatiron District of Manhattan. According to a Gothamist news report, the 60-year-old man was struck by a bicyclist riding north in the bike lane near the intersection of Sixth Avenue and West 23rd Street on July 31. The man died Aug. 7 of head injuries suffered in the crash. Police say they are still looking for the bicyclist who did not stop after the crash.
Pedestrian Accidents in NYC
NYC Crash Mapper shows that since 2015, at least nine crashes have occurred at that intersection injuring both bicyclists and pedestrians. That was also the location where a bicyclist was struck and killed by a truck in June. Mayor Bill de Blasio’s administration, which recently announced a “Green Wave” cycling safety plan in response to the drastic increase in the number of bicyclists killed so far this year (compared with 10 in all of 2018), also identified Sixth Avenue as a protected bike lane project.
The pedestrian who recently died is the second to be fatally struck by a bicyclist this year. On April 25, a woman was struck by a bicyclist in a crosswalk at West 57th Street between Fifth and Sixth Avenues. The woman died of her injuries and the bicyclist who struck her was issued a summons for running a red light. Since 2009, at least five pedestrians have been killed in collisions with bicyclists.
However, statistics show that motorists overwhelmingly cause deaths and injuries on city streets. New York State traffic data show that in 2018, there were about 47,000 traffic collisions in New York City killing 115 pedestrians, 78 motorists and 10 bicyclists. Also, 11,053 pedestrians and 270 bicyclists were injured in those crashes. Safety advocates say that bicyclist versus pedestrian collisions account for less than 1 percent of pedestrian deaths while since January 2014 motorists have killed 700 pedestrians.
Pedestrian accidents, whether they involve collisions with automobiles or bicyclists, have the potential to result in catastrophic injuries or even fatalities. Because they lack personal protection, pedestrians suffer disabling injuries such as head trauma, back and neck injuries, complex fractures, internal organ damage, etc. These types of injuries turn individuals’ lives upside down because they are unable to return to work for a long period of time, or even permanently.
Victims who have been injured in pedestrian accidents may be able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. It is important to remember that pedestrian accident victims may be able to seek compensation for injuries or losses in a collision even if they were not walking in a marked crosswalk. Also, if a hit-and-run driver has injured you, you can seek compensation through the uninsured motorist clause of your auto insurance policy even though the driver has not been identified or through a quasi-state agency if there is no motor vehicle in the victim’s household. But you should hire an experienced personal injury attorney to handle the case for you as there are many pitfalls.
A family that has lost a loved one in a pedestrian accident may be able to file a wrongful death lawsuit seeking compensation as well. An experienced personal injury lawyer will be able to guide you through what can quickly become a complex process and help you maximize the compensation you receive.
