Aluminum Plant AccidentA 46-year-old man was killed on the job at an aluminum plant. According to a news report in The Wall Street Journal, the fatal accident occurred at an aluminum rolling plant in Scriba. The man was working with machinery at the plant when he was seriously injured. He died from his injuries the following day. Investigators have not reported how the accident occurred or if the plant had a history of safety violations.
New Jersey workers who work with heavy machinery and equipment are in constant danger of being injured. The U.S. Bureau of Labor Statistics reports that 732 workers were killed in the year 2010 in accidents involving contact with objects and equipment. Also, 224 workers were killed after being compressed by equipment or objects that year. Additionally, 90 employees were fatally injured after being caught in running equipment or machinery.
Anytime there is an injury accident involving machinery or equipment, it must be determined how it occurred and how it could have been prevented. Did the employer fail to maintain the equipment? Was the worker trained on how to use the equipment safely? Did the machinery have guards to prevent people or body parts from being pulled inside? Does the equipment have an emergency shut off switch? Are the workers provided adequate supervision?
The family of a deceased worker can seek compensation for their tremendous loss through workers compensation benefits. In certain cases, families may be able to file third-party claims against parties other than the employer. Examples of third parties include, but are not limited to, general contractors, sub-contractors, property owners, manufacturers of defective products, and equipment maintenance contractors.
