Pedestrian Accidents LawyerThree people were killed in separate Long Island pedestrian accidents that occurred over a span of under 24 hours. According to Newsday.com, Nassau police identified one of the victims who was killed the evening of Nov. 27 at 51-year-old Sulfa Sanchez. Police said she was struck by a sedan as she crossed Merrick Road near Henry Street. Sanchez was transported to a local hospital where she was pronounced dead. The driver of the vehicle remained at the scene. Police said the investigation into that incident is ongoing.

An hour before Sanchez was struck, another pedestrian was hit and fatally injured on Eisenhower Avenue in Brentwood. That pedestrian was struck when the driver of a sedan attempted to make a left turn from Eisenhower onto Suffolk Avenue, Suffolk County police said. Earlier that day in Bohemia, 51-year-old Joan Foley was the victim of a fatal hit-and-run as she attempted to cross Veterans Memorial Highway. Police did not provide a description of the driver or the vehicle that struck Foley. Investigations are ongoing. We offer our deepest condolences to the families of these victims for their heartbreaking loss.

Driver Carelessness and Pedestrian Accidents

Pedestrian accidents in New York City are often the result of driver negligence (carelessness), which can manifest in a number of ways. One common cause is distracted driving, where drivers divert their attention from the road to activities such as texting, calling, or adjusting in-car controls. With NYC’s high pedestrian traffic, even a momentary lapse in attention can lead to devastating consequences.

Speeding is another major factor. Many drivers routinely exceed speed limits in New York City. In dense urban settings, higher speeds significantly reduce reaction times and increase the severity of injuries in the event of a collision.

Failure to yield the right of way at crosswalks is also cited frequently as a cause of major injury pedestrian accidents. Pedestrians have the legal right to cross, but drivers may disregard this — either intentionally or due to inattentiveness — leading to tragic collisions.

Additionally, running red lights or stop signs contributes to many pedestrian accidents. Such reckless behavior increases the likelihood of striking someone who is crossing at intersections. Driving under the influence (DUI) of alcohol or drugs further worsens the problem. Impaired drivers have diminished judgment, slower reaction times and poor coordination, making them a significant hazard to all those using the roadway.

Injuries and Compensation

Traffic accidents have the potential to result in catastrophic injuries and fatalities. Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

Pedestrian accident victims and their families should remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.

Also, in a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run crash, he or she can be held financially liable for the injuries, damages and losses caused.

Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. You should consult a personal injury lawyer immediately to protect your rights.
