Spate of Major Injury Pedestrian Accidents in New York City

A 33-year-old man suffered critical injuries in a pedestrian accident in Astoria, Queens, which police said, involved a hit-and-run driver. According to a Patch.com news report, the man was crossing 31st Avenue at 33rd Street, heading north, early morning on May 6, when a black sedan driving west along 31st Avenue hit him.

The driver struck the victim at the intersection and then fled the scene, police said. Officers who responded found the pedestrian unconscious and unresponsive. He was lying on the street with head and body trauma, officials said. He was rushed to a local hospital where he remained in critical condition. No one has been arrested yet, but police are still investigating the crash.

Series of Deadly Accidents

The crash came in the wake of a particularly deadly week for New York City’s streets with several fatal pedestrian and bicycle accidents happening just over the last few days. On May 2, Raife Milligan, a 21-year-old NYU student was struck and killed by a suspected drunk driver in the East Village. The deadly crash occurred as Milligan was crossing East Houston and 1st Avenue.

Also, on May 5, 16-year-old Alissa Kolenovic, was fatally struck by a beverage delivery truck driver at Neill Avenue in Morris Park. Police said the delivery truck driver was making a left onto Paulding Avenue when he collided with the teen. He was charged with failure to yield to a pedestrian and failure to use due care.

On May 6, 38-year-old Karina Larino was struck at 21st Street and Astoria Park South by a 73-year-old driver making a turn on to 21st Street. Police said Larino was walking outside of a crosswalk.

Pedestrians’ Right of Way

A number of major injury and fatal pedestrian accidents in New York City occur due to motorists failing to yield the right of way to pedestrians. Over the last week, we have also seen impaired drivers and motorists who fled the scene of an injury or fatal collision. Pedestrians who are injured by delivery trucks can file a lawsuit seeking compensation against the truck driver and the trucking company or corporation that owns/or operates the truck. An experienced New York pedestrian accident lawyer will be able to determine the liable parties in such cases.

Motorists are required under the law to stop and yield the right of way to pedestrians in crosswalks. When there is no traffic control signal at a crosswalk, drivers must yield the right-of-way to pedestrians, particularly if the pedestrian is in a crosswalk or there is potential danger to the pedestrian (Section 1151, NYS Vehicle & Traffic Law). In addition, every driver approaching an intersection or crosswalk must yield the right-of-way to a pedestrian accompanied by a guide dog or a cane (Section 1153-c, NYS Vehicle & Traffic Law).

Injuries and Compensation

Pedestrian accident victims and their families should remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her. Also, if a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household.

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in such accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
