Police in the Bronx are looking for a tow truck operator who they say struck and killed a woman outside a hospital in a hit-and-run collision early morning on Dec. 7. According to an amNewYork news report, the deadly pedestrian accident occurred at the corner of Seddon Street and St. Raymond Avenue, steps away from Montefiore Westchester Square Hospital. Police said the victim, a 56-year-old woman, was struck by the unidentified driver of a white truck as she crossed the intersection.
After hitting the woman, police said, the driver did not stop and instead, sped away from the scene heading east on Seddon Street toward East Tremont Avenue. Staff members at the hospital ran out to provide aid to the victim who had suffered severe head trauma, based on the news report. However, the victim could not be saved. Police have withheld her name pending family notification. NYPD’s Collision Investigation Squad is leading the ongoing investigation into this fatal hit-and-run crash. Our thoughts and prayers are with the family of the deceased victim.
Hit-and-Run Laws in New York
In New York City, a driver involved in an injury accident has strict legal responsibilities under New York Vehicle and Traffic Law § 600. The driver must immediately stop at or near the scene and remain present to fulfill their duties. They are required to provide their name, address, and insurance information to law enforcement or other parties involved. Additionally, the driver must call 911 to report the accident and request medical assistance if needed.
Leaving the scene of a fatal accident is a serious offense and is classified as a Class D felony. This crime carries severe penalties, including significant fines and imprisonment. In addition, family members of the deceased victim can file a civil lawsuit against the driver (when identified) as well as his or her employer (if the driver was on the job at the time of the crash), seeking compensation for their losses.
Injuries and Compensation
Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.
Pedestrian accident victims and their families should remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused.
Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. You should consult a personal injury lawyer immediately to protect your rights.
