NYC Sanitation Worker Charged in Pedestrian Accident

A 34-year-old city sanitation worker who hit and seriously injured an 81-year-old woman with his truck as she crossed a Brooklyn street, has been arrested and charged with failure to yield the right of way to a pedestrian, the New York Daily News reported. According to the report, the truck driver was making his rounds the morning of Oct. 6 when he made a left turn from 85th Street onto 15th Avenue in Bensonhurst, striking the elderly woman who was crossing 15th Avenue.

Series of Pedestrian Accidents in NYC

The pedestrian accident victim suffered severe leg injuries and was transported to an area hospital where she remained in critical condition. The truck driver has been charged with failure to exercise due care and failure to yield the right of way to a pedestrian. This accident was one of several bloody traffic crashes in the city that day.

In Midtown, a man in his 40s was crushed to death by an 18-wheeler truck as he was crossing Eighth Avenue at West 44th Street. The driver ran over the pedestrian and kept going, witnesses said. Several eyewitnesses managed to stop the truck, but the driver claimed he did not know he had struck the pedestrian.

Also on Thursday, 10 people were hurt after a police car responding to a call clipped another car, went out of control and plowed into a group of people on the sidewalk. An ABC report said four pedestrians were struck on the sidewalk including a 5-year-old. That child and three other victims were transported to a hospital in critical condition. Our thoughts and prayers are with these accident victims and their families.

Pedestrians’ Rights

A number of major injury and fatal pedestrian accidents in New York City occur due to motorists failing to yield the right of way to pedestrians. Motorists are required to yield the right-of-way to pedestrians, particularly if the pedestrian is in a crosswalk or if there is potential danger to the pedestrian (Section 1151, NYS Vehicle & Traffic Law). In addition, every driver approaching an intersection or crosswalk must yield the right-of-way to a pedestrian accompanied by a guide dog or a cane (Section 1153-c, NYS Vehicle & Traffic Law).

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from the at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
