Wendy Davis, also known as Wenne Alton Davis, 60, who appeared on Amazon’s “The Marvelous Mrs. Maisel,” was fatally injured in a pedestrian accident at a Midtown Manhattan intersection. According to an AMNY news report, police responded to a 911 the night of Dec. 8 that a pedestrian had been struck at the intersection of West 53rd Street and Broadway. Davis had been hit by a 61-year-old male driver behind the wheel of an SUV.
Police said the driver was traveling west in the left-hand lane on West 53rd Street and ended up striking Davis while making a left turn onto Broadway. Davis suffered trauma to her head and body, and was transported to Mount Sinai West hospital where she was pronounced dead. The driver, who was uninjured in the crash, remained at the scene, police said. The NYPD has yet to make an arrest, pending an official investigation. According to NYC Crash Mapper, there have been three crashes involving four injuries at that same intersection over the past year.
Crosswalk Accidents, the Law and Victims’ Rights in NYC
Under New York Vehicle and Traffic Law, pedestrians have the right of way when crossing within a marked crosswalk or unmarked crosswalk, or at an intersection with a walk signal. Drivers are required to yield, exercise due care and remain alert for pedestrians at all times. Failure to do so can constitute driver negligence (carelessness).
Driver negligence in crosswalk accidents may include speeding, distracted driving (such as texting), failure to yield while turning, running red lights or driving while impaired, etc. Pedestrians’ rights include the ability to seek compensation for medical expenses, lost wages and benefits, pain and suffering and long-term disability, etc. If the pedestrian accident results in death, the victim’s family may be able to seek compensation from the at-fault parties by filing a wrongful death lawsuit for damages such as medical expenses, lost future income, pain and suffering, etc.
New York City’s Vision Zero initiative further emphasizes pedestrian safety, reinforcing stricter enforcement against dangerous driving behaviors. Ultimately, drivers bear a heightened responsibility in crosswalks because pedestrians are especially vulnerable. When drivers ignore traffic laws or fail to use reasonable care, they can be held legally accountable for the serious harm that often results from crosswalk accidents.
Contacting an Experienced Lawyer
If you or a loved one has been injured in a bicycle accident or pedestrian accident, or if you have lost a loved one in an auto accident caused by a negligent (careless) driver, the experienced New York personal injury attorneys at the Law Offices of Kenneth A. Wilhelm can help you better understand your legal rights and options, and also fight hard to recover just compensation for you. It is in the best interest of injured victims and their families in such cases to contact an experienced personal injury lawyer before contacting the people responsible for the injuries, and definitely before contacting or communicating with any insurance company, or their lawyers, investigators, or adjusters.
