Man Suffers Critical Injuries in Midtown Pedestrian Accident

A 34-year-old man was critically injured in a pedestrian accident after he was hit by a bus in Midtown. According to a report in the New York Post, the man was crossing the street between 34th Street and 9th Avenue in Hell’s Kitchen the night of Sept. 30 when a charter bus struck him. He was transported to a local hospital where he was listed in critical condition.

The bus, which the Post reported was operated by a Long Island-based charter bus company, remained on the scene following the incident. No charges or citations were reported. The investigation into this major injury pedestrian accident is still ongoing. Our thoughts and prayers are with the injured pedestrian. We wish him the best for a speedy and complete recovery.

Fatal Pedestrian Accidents in NYC

In the first three months of 2022, 59 people were killed on New York City’s streets, which was nearly a 44% increase compared to 2021. This was also the worst start to any year since the city’s Vision Zero safety effort began in 2014, a recent report stated. These horrifying pedestrian accident statistics prompted Mayor Eric Adams to pledge significant funding ($904 million) toward constructing additional bike and bus lanes and pedestrian spaces.

Failing to yield to pedestrians in crosswalks and intersections is one of the most common causes of fatal pedestrian accidents in New York City. Drivers are required under the law to stop and yield the right of way to pedestrians in crosswalks. When there is no traffic control signal at a crosswalk, drivers must yield the right-of-way to pedestrians, particularly if the pedestrian is in a crosswalk or if there is potential danger to the pedestrian (Section 1151, NYS Vehicle & Traffic Law). In addition, every driver approaching an intersection or crosswalk must yield the right-of-way to a pedestrian accompanied by a guide dog or a cane (Section 1153-c, NYS Vehicle & Traffic Law).

Serious Injuries from Auto Accidents

Pedestrian accidents have the potential to result in catastrophic injuries ranging from traumatic brain injuries and spinal cord trauma to broken bones and internal organ damage. Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.

If you or a loved one has been injured in a pedestrian accident or bicycle accident, or if you have lost a loved one in an auto accident caused by a negligent (careless) driver, the experienced New York personal injury attorneys at the Law Offices of Kenneth A. Wilhelm can help you better understand your legal rights and options, and also fight hard to recover just compensation for you.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
