Man Killed After Being Hit by FedEx Truck in the Bronx

truck accident attorneyA 65-year-old man was fatally struck by a FedEx vehicle the morning of March 29 in the Bronx neighborhood of Kingsbridge Heights. According to a News 12 report, the man was crossing West Kingsbridge Road near University Avenue when he was hit by the delivery truck. It is said that surveillance video showed the victim was walking as the red walk signal flashed at the intersection when the FedEx truck turned the corner and ran over the man. The victim succumbed to his injuries at a local hospital.

The 24-year-old FedEx driver remained at the scene and no arrests were made, according to the News12 report. The city’s Vision Zero data shows that the intersection where this pedestrian accident occurred is one of 3,000 “priority intersections,” which has the highest number of pedestrians killed or severely injured in the five boroughs. We offer our deepest condolences to the family members of the deceased victim for their tragic loss. The investigation is ongoing.

Pedestrian Accidents Involving FedEx Trucks

FedEx trucks, like other large commercial vehicles, pose significant risks to pedestrians, especially at busy intersections. Collisions between trucks and pedestrians tend to occur due to factors such as driver fatigue, distracted driving, limited visibility and failure to yield at crosswalks. Additionally, the sheer size and weight of delivery trucks mean that even low-speed impacts can result in severe injuries or fatalities.

Pedestrians are particularly vulnerable in areas where trucks frequently stop, such as busy streets, apartment complexes and commercial zones. Sudden stops, wide turns and drivers maneuvering in reverse increase the likelihood of accidents. Poor lighting and bad weather conditions further elevate the risks.

Who is Liable for a Delivery Truck Accident?

Liability for a delivery truck or van accident may depend on several factors, including the cause of the crash, the driver and his or her employer as well as any third-party who are held responsible. In many cases, the employer/trucking company can be held responsible if the driver was on duty and acting within the scope of their employment. Companies are required to ensure their drivers are properly trained and that their vehicles are well-maintained. If negligence (carelessness) is found in these areas, the company may be liable.

The driver may also bear responsibility if their actions directly caused the accident. This includes reckless driving, distracted driving, speeding or driving under the influence. If the driver is classified as an independent contractor rather than an employee, determining liability can be more complicated. Additionally, third parties, such as vehicle manufacturers, maintenance providers or even other drivers on the road, may share liability. For example, if faulty brakes or poor vehicle maintenance contributed to the accident, the manufacturer or maintenance provider may be held accountable.
