A jury in a medical malpractice lawsuit has awarded $26,000,000 to a 6-year-old boy in Brooklyn who as a newborn was discharged from New York Methodist Hospital despite a severe case of jaundice. According to the New York Daily News, jurors found that the hospital’s negligence in not treating the jaundice caused the boy’s brain to became severely damaged.
Lack of Treatment Leads to Disability
According to the lawsuit, the boy was released from the hospital without a proper exam or follow up although his mother complained about her child’s yellowing skin. This was an entirely preventable case. The boy is now permanently disabled. He cannot use his arms or legs and cannot speak. Although jaundice is common in newborns, it should be treated immediately.
Instead, the family was told that the illness would go away on its own. The boy was eventually diagnosed with a severe jaundice that causes brain damage and cerebral palsy. The hospital had denied wrongdoing and has vowed to appeal the jury award. The boy’s family members say the award will allow them to provide round-the-clock care for the boy.
