New York Construction AccidentAn ironworker was injured in a construction accident at a high school in Hornell, New York. According to a WETM news report, the incident occurred on April 27 at the high school’s gymnasium. The worker was injured when the bar joists that he was assembling tipped over and landed on him. Following his injury, other workers and the school nurse helped the victim until an ambulance arrived. The worker was transported to Strong Memorial Hospital in Rochester.

Officials said the worker is in stable condition after undergoing back surgery. The school’s superintendent also told the news outlet that doctors are hoping that the worker won’t experience permanent spinal cord damage. The Occupational Safety and Health Administration (OSHA) has opened an investigation into this construction accident.

Ironworking Accidents and Spinal Injuries

Ironworkers face significant hazards due to the conditions, equipment, etc. such as heavy materials, powerful tools and heights or elevation they need to work on or use. One major risk is suffering fall-related injuries, especially when working at elevated levels. Without proper harnesses or guardrails, even a small misstep can lead to serious injury or death. Another common danger is being struck by falling objects such as beams, tools, or debris, which can cause head injuries, eye injuries or crushing accidents.

Struck-by incidents are among the most dangerous hazards for ironworkers and often lead to severe spinal injuries. These accidents occur when a worker is hit by moving, falling, or swinging objects such as steel beams, tools or crane loads. The force of impact can compress or twist the spine and damage vertebrae, discs or even the spinal cord.

For example, if a suspended beam shifts unexpectedly and strikes a worker’s back, it can cause fractures or dislocations in the vertebrae. Falling objects from above are especially dangerous because gravity increases their impact force, potentially leading to paralysis if the spinal cord is affected. Even smaller objects, when dropped from height, can generate enough force to cause serious trauma.

Compensation for Injured Workers

Many construction workers in New York City such as roofers, ironworkers, steelworkers, carpenters, masons, bricklayers, painters, window washers, and electricians etc. tend to work from an elevation by using scaffolds, platforms, ladders etc. When a construction worker is injured on the job, the first line of financial protection is usually workers’ compensation, which provides benefits irrespective of fault – covering medical expenses, a portion of lost wages and rehabilitation costs. However, workers’ compensation does not cover pain and suffering and benefits are often limited compared to the full extent of losses. The large verdicts and settlements occur when others are sued in third-party cases.

In some situations, injured workers may also pursue a third-party lawsuit in addition to workers’ compensation. These claims arise when someone other than the employer — such as a subcontractor, equipment manufacturer, or property owner or manager — contributed to the accident. For example, if defective machinery caused the injury, the manufacturer may be held liable. Third-party lawsuits can provide compensation for damages not covered by workers’ compensation, including pain and suffering, emotional distress and full lost earnings, and these verdicts and settlements can be quite large.
