Driver Charged in Fatal Brooklyn Crosswalk Pedestrian Accident

pedestrians accident lawyerPolice have charged a 32-year-old Brooklyn woman in connection with a pedestrian accident in Brooklyn that killed Natasha Saada, 34 and her daughters Diana, 8, and Deborah, 5. According to an NBC news report, police say 32-year-old Miriam Yarimi was driving north on Ocean Parkway when she struck the rear bumper of a Toyota Camry turning right from Quentin Road. Police say Yarimi lost control of her car and crashed into the pedestrians before flipping the sedan, which landed on its roof.

Driver Had a Record of Violations

Yarimi is facing charges of manslaughter, criminal negligent homicide, assault, reckless driving, failure to yield right on a red light and speeding and driving on a suspended license. Transportation Alternatives, a traffic safety advocacy group, pointed to the driver’s record saying she was operating a vehicle on a suspended license and that the vehicle she was driving has more than 90 tickets including more than 13 school zone speeding tickets last year.

The group urged New York lawmakers to pass legislation that would install speed limiters on vehicles of the “most reckless repeat speeders.” We offer our deepest condolences to the members of the Saada family for their tragic and heartbreaking loss.

Crosswalk Safety and Pedestrian Injuries

In New York City, the law requires motorists to yield the right of way to pedestrians in crosswalks. Under New York Vehicle and Traffic Law (VTL) Section 1151, drivers must yield the right of way to pedestrians crossing within marked or unmarked crosswalks at intersections. Reckless driving, defined under VTL Section 1212, occurs when a driver operates a vehicle in a manner that unreasonably endangers others. This includes excessive speeding, aggressive lane changes, failing to yield and running red lights.

Common injuries in such accidents caused by driver negligence include fractures, traumatic brain injuries, spinal damage, internal bleeding and lacerations. The severity of injuries depends on the speed and impact of the vehicle. New York City, with its dense traffic and high pedestrian volume, sees a significant number of crosswalk accidents each year. Even when pedestrians have the right of way, drivers who run red lights, make illegal turns, or fail to yield to pedestrians can cause devastating injuries.

Injured victims may be able to seek compensation for damages including, but not limited to medical expenses, lost income and benefits, cost of hospitalization, rehabilitation, permanent injuries, past and future pain and suffering, etc. Families of deceased pedestrian accident victims can seek compensation by filing a wrongful death claim against the at-fault parties.
