Citi Bike Van Driver Charged with Failure to Yield to Pedestrian

The driver of a Citi Bike van who struck a 72-year-old woman crossing a street in Brooklyn has been charged with failure to yield to a pedestrian. According to a report in the New York Daily News, the 51-year-old driver was given a desk appearance ticket in connection with this pedestrian accident.

The victim was rushed to a local hospital in critical condition with head injuries after the Citi Bike van struck her as she tried to cross Dekalb Avenue. The van driver hit the woman while turning right onto Dekalb Avenue from Clinton Avenue in Clinton Hill. Police said that while the driver had the green light, the victim had the walk signal and the right of way at the time.

Failure to Yield to Pedestrians

Motorists in New York are required to stop and yield the right of way to pedestrians in crosswalks and at intersections. While in this case, both the driver and the woman had the light, the motorist was still required to stop and yield the right of way to the pedestrian who had the “walk” signal.
