Child Killed in Queens Pedestrian Accident

Bayron Palomino Arroyo, 8, was killed and his 10-year-old brother was injured in a Queens pedestrian accident the afternoon of March 13, Streetsblog NYC reports. Both children were struck by a pickup truck that was making a left turn onto the southbound side of 100th Street from 31st Avenue. Police say the 52-year-old driver accelerated too quickly when making the turn and struck the two children who were crossing the road. The driver was arrested and the investigation is ongoing. Jose Barcia was waiting to make a left turn onto 100th Street at a red light. When the light turned green, witnesses said, Barcia crossed over the double yellow line and around another driver who was first in line at the light. He then struck the pedestrians.

Streetsblog reports that the driver, Jose Barcia, was driving with a valid license in spite of having been arrested four times previously for driving without a license. It is not clear why Barcia was able to get a driver’s license after those arrests. His vehicle had also racked up eight camera-issued speeding tickets just since last June and has more than the threshold of $350 in unpaid, adjudicated tickets that allow the Sheriff’s department to tow away the vehicle. However, his pickup truck was not towed. He is facing one count of criminally negligent homicide in connection with this fatal pedestrian crash.
