Ten people were injured in a pedestrian accident that sent a van onto a sidewalk in Chelsea after a box truck plowed into it from behind. According to an NBC New York news report, the incident occurred at the corner of Eighth Avenue and West 30th Street in Chelsea the afternoon of Oct. 20. Police said a box truck was driving along Manhattan Avenue when it barreled into the back of a parked van that was sent ricocheting onto the sidewalk. Eight people who were waiting at the bus stop were injured. Two people who were in the box truck were also injured.
Cellphone video showed the chaos moments after the crash, as injured people were knocked to the ground. Witnesses told NBC that a woman was pinned against a wall. All injured victims are expected to survive, but one person sustained critical injuries. It was not clear what caused the box truck to plow into the van. No charges have been filed as the investigation is ongoing, according to reports. Our thoughts and prayers go out to the injured victims of this crash. We wish them the very best for a speedy and complete recovery.
Pedestrian Injuries Caused by Car Accidents
Seeking legal recourse in such cases, where a pedestrian is injured as a result of a collision between two other vehicles, is complex and involves several layers of potential liability and rights to compensation. In New York State, even pedestrians injured by a vehicle are covered under the at-fault driver’s no-fault or Personal Injury Protection (PIP) insurance. This means your immediate medical bills and a portion of lost earnings (up to the statutory threshold) may be covered regardless of fault.
To pursue additional compensation (for pain and suffering, long-term disability, loss of future earnings, etc.) you generally must show that your injury meets the “serious injury” threshold under New York law (for example a fracture, significant limitation, or economic loss over a certain amount, etc.) and that a driver was negligent (careless). If two vehicles collide and one (or both) causes the trajectory of a vehicle to strike the pedestrian, you may need to determine which driver’s negligence (carelessness) led the incident, or if both did. That chain of events complicates proving causation but does not eliminate your rights. It may mean multiple parties are liable.
What to Do If You Are Injured
- Seek immediate medical attention and document your injuries.
- Report the incident to the police and obtain a copy of the police report. Your injury lawyer can also help you obtain a copy of the police report.
- Collect evidence including photos of the scene, vehicles, driver information, witness contact, traffic camera footage if possible.
- Consult an experienced personal injury attorney who can help ensure that you receive maximum compensation for your losses.
