An unlicensed pickup truck driver struck and fatally injured a 58-year-old woman
who was crossing an intersection in Queens while holding her 19-month old granddaughter. According to an NBC New York news report, the fatal pedestrian accident occurred at the intersection of a Cross Island Expressway service road and 150th Street. The woman was hit by the pickup truck while walking northbound in a marked crosswalk, holding the baby.
The unlicensed driver of the pickup, a 43-year-old man, was trying to turn left onto the service road from 150th Street when he struck the woman and child, police said. The woman was unconscious and unresponsive when first responders arrived at the scene. She was rushed to a local hospital where she died due to her injuries. The young child she was holding was conscious and alert at the scene and was in stable condition with relatively minor injuries, officials said.
The driver remained at the scene and attended to the victims. He was taken into custody and charged with driving without a license, failure to yield to a pedestrian and failure to exercise due care. The investigation is ongoing. Our thoughts and prayers are with the family members of the deceased victim.
Failure to Yield Right of Way
Drivers in New York are required to stop and yield the right of way to pedestrians in crosswalks and at intersections. In this case, according to the police, the driver failed to yield the right of way to a pedestrian who was walking legally in a marked crosswalk at the intersection and reportedly did not have a valid driver’s license.
Pedestrians have the right of way in all crosswalks and intersections with marked or unmarked crosswalks. The law also states that motorists turning right or left at an intersection should always look for pedestrians and yield the right of way to them. Pedestrians have the right of way at intersections, even if drivers have a green light.
Some of the deadliest pedestrian accidents occur in crosswalks and at street intersections. Failure to yield the right of way to pedestrians is one of the most common causes of vehicle versus pedestrian accidents in crosswalks and at street intersections. A driver may fail to see a pedestrian who is crossing at an intersection due to his or her impairment, inattention or distraction, etc.
