Woman Critically Injured in Brooklyn Pedestrian Accident

Pedestrian accident lawyerA 49-year-old woman is in critical condition after she was struck by the driver of a pickup truck in the Greenpoint neighborhood of Brooklyn. According to a report in the Brooklyn Paper, the pedestrian accident occurred the night of Feb. 21 when the woman was crossing Sutton Street at Nassau Avenue. Officials said the driver, 68-year-old Stanley Manel, turned left from Nassau Avenue in his pickup truck and hit the victim in the crosswalk.

When officers arrived, they found the woman lying in the roadway with head trauma. She was rushed to a local hospital in critical condition. Manel remained at the scene after the crash. He was arrested and charged with failure to yield and failure to exercise due care, the news outlet reports.

Speeding and Reckless Driving

Greenpoint neighbors told the Brooklyn Paper that they were frustrated by dangerous roadways that make it risky for pedestrians to get around. The outlet also reports that the driver in this case had racked up 35 tickets since 2019 including 26 school speed zone camera violations. Streetsblog NYC reports that he was able to pay the ticket fines and get away without any further repercussions. City officials also said Manel was speeding at the time of this pedestrian accident and made the left turn onto Sutton Street without using the turn signal.

There are bills currently in state legislature that would require drivers who accumulate more than six speed or red-light violations in a 12-month period to install speed control devices in their vehicles. Local politicians also urged the city’s Department of Transportation to install measures such as raised crosswalks on Nassau Avenue to slow drivers down and improve pedestrian visibility and safety. They wrote in their statement that “what is at stake is the ability to cross the street to pick up a quart of milk at the corner store and make it home alive.”

There is no doubt that increased speed and negligent (careless) driving can put pedestrians at risk of serious injuries including head trauma, spinal cord damage, internal injuries, fractures, etc. Many of these injuries can also become fatal for pedestrians. Studies have repeatedly shown that the higher the speed of a vehicle while striking a pedestrian, the greater the injury.

Compensation for Victims

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
