Two Pedestrians Killed in NYC Crashes 12 Hours Apart

pedestrian accident attorneyTwo pedestrians were killed barely 12 hours apart, one by a driver who officials said was under the influence and another, in a hit-and-run crash. According to a report in the New York Post, Louis Garcia was crossing Glenwood Road at the East 105th Street intersection in Canarsie, Brooklyn, the evening of Jan. 31 when a vehicle, which officials said, was driven by an impaired man struck him, throwing the victim to the pavement. Garcia suffered head trauma and was rushed to a local hospital where he was pronounced dead. The driver, identified as 47-year-old Gary Turner, was charged with vehicular manslaughter, criminally negligent homicide, driving while intoxicated, an equipment violation, and driving while ability impaired.

About 12 hours later, a hit-and-run driver struck and killed a 67-year-old woman in Jackson Heights, Queens. The woman, who was crossing north to south on 90th Street, was struck by an SUV that was heading east on 37th Avenue. The driver took off without stopping. The woman died at a local hospital. The driver was still at large. Investigations into both fatal pedestrian accidents are ongoing.

Dangerous Street Intersection

According to the New York City Department of Transportation, there have already been 19 traffic accident fatalities this year. Nine of those deaths involved pedestrians — a number that is up from seven during the same period last year. Injuries are also up 2.6% so far in 2024, with 3,465 people injured in traffic accidents. That’s just in the first 28 days of 2024 averaging 123 people injured each day.

Streetsblog reports based on city statistics that in 2023, there were 86 reported crashes just between 69th and 95th streets, resulting in 45 injuries, including seven to bicyclists and 16 to pedestrians. The same length of Seventh Avenue in Park Slope had 41 reported crashes causing 22 injuries. The news outlet also reports that Garcia’s death on Glenwood Road in the crosswalk at E. 105th Street was the second death on Glenwood Road in less than a week. Transportation Alternatives, a traffic safety advocacy group, reports that the two-mile stretch of Glenwood Road is dangerous, with 10 serious injuries reported there since the beginning of 2022.

Compensation for Victims and Families

In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused.

Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. You should consult a personal injury lawyer immediately to protect your rights.

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
