Hit-and-Run Bicycle Accidents
Hit-and-run bicycle accidents are a serious problem in New York City where dense traffic and limited bike lane protection put cyclists at high risk. Under New York law, drivers involved in an accident must stop, exchange information and provide assistance if someone is injured. Failing to do so is a criminal offense. The penalties vary depending on the severity of the crash. Leaving the scene of an accident causing property damage is a misdemeanor while fleeing after causing injury or death can result in felony charges, steep fines and potential imprisonment.
For injured bicyclists, the consequences are often devastating. Because they lack the protection of a vehicle, bicyclists struck by cars frequently suffer severe injuries. Common outcomes include bone fractures, concussions and traumatic brain injuries, spinal cord damage, internal bleeding and deep lacerations. Even when injuries are not life-threatening, they may require extensive rehabilitation and leave victims unable to work.
Victims of hit-and-run crashes may pursue compensation through the driver’s insurance if the offender is identified. If not, they may still access benefits through their own auto insurance policy or the Motor Vehicle Accident Indemnification Corporation (MVAIC). Seeking prompt legal counsel is often essential to successfully navigating a bicycle accident claim.
Can Hit-and-Run Victims Seek Compensation?
Injured victims of bicycle accidents and pedestrian accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.
In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused.
Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. You should consult a personal injury lawyer immediately to protect your rights.
