Maria Elena-Andres Martinez, 35, suffered fatal injuries the morning of Oct. 14Â after the ambulance taking her to the hospital was struck by another vehicle. According to a NY1.com news report, Martinez was being transported in the ambulance after she had been injured in a pedestrian accident. Earlier, the victim was crossing Jewett Avenue at the intersection of Keiber Court in Westerleigh when a driver in a sedan struck her leaving her in critical condition, NYPD officials said.
Ongoing NYPD Investigation
The sedan’s driver remained at the scene and emergency personnel
arrived to take Martinez to a hospital. As the ambulance was driving on Maine Avenue, a Jeep traveling west on Jewett Avenue struck the emergency vehicle. Police said the ambulance was going the wrong way on a one-way street. Martinez and three EMS workers were then taken to an area hospital where the first responders were listed in stable condition.
Martinez, however, succumbed to her injuries. The Jeep’s driver was also listed in stable condition. No one has been arrested in connection with either crash pending an official investigation. Our thoughts and prayers are with the family of Maria Elene-Andres Martinez as well as the others who were affected by the crash.
NYC Traffic Laws
A number of major injury and fatal pedestrian accidents in New York City happen because drivers fail to yield the right of way to pedestrians. Motorists are required under the law to stop and yield the right of way to pedestrians in crosswalks. When there is no traffic control signal at a crosswalk, drivers must yield the right-of-way to pedestrians, particularly if the pedestrian is in a crosswalk or if there is potential danger to the pedestrian (Section 1151, NYS Vehicle & Traffic Law). In addition, every driver approaching an intersection or crosswalk must yield the right-of-way to a pedestrian accompanied by a guide dog or a cane (Section 1153-c, NYS Vehicle & Traffic Law).
What Compensation Can Victims Seek?
Injured victims of pedestrian accidents and bicycle accidents can seek compensation from the at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
In such cases, it is important that you immediately take steps to protect your rights. Collect evidence (if you can) at the scene. This should include photos of the location, the vehicle as well as your injuries. Obtain contact information for the motorist and the person who caused your injuries. It is also important to get the driver’s license number and insurance details. File a police report and obtain a copy for your records. Your New York pedestrian accident lawyer can also do that for you. If you are injured and unable to collect information, ask a friend or family member if they can do that for you. Your personal injury lawyer can also help gather this evidence.
Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
