A woman was killed in a pedestrian accident on Manhattan’s Upper East Side, after she was struck twice, first by a hit-and-run driver in a sedan and then by an MTA bus. According to a WPIX news report, the woman, who was in her 20s or 30s, was crossing Third Avenue near East 96th Street the evening of Dec. 8 when she was first hit by a sedan. Police said the woman had been walking in the crosswalk. The driver of the vehicle involved, described as a black sedan with a loud exhaust pipe, fled the scene, officials said.
Ongoing Investigation
An MTA bus then struck the woman. The bus driver remained at the scene. First responders transported the woman to an area hospital, but she succumbed to her injuries. Because the victim did not have identification on her, police are still trying to identify her and locate her family.
PIX11 reports that the intersection where this hit-and-run occurred does not have a traffic camera. Detectives were looking for surveillance video along Third Avenue in hopes of finding more evidence that will lead them to the driver. No arrests had been made as of the weekend. The investigation is ongoing.
Claim for Compensation
Motorists are required under the law to come to a full stop at crosswalks and intersections where pedestrians are crossing. Failure to yield the right of way is one of the most common causes of fatal and major injury pedestrian accidents in New York City. According to city crash data, since 2012 at least 63 people have been injured in 58 crashes at the intersection where this victim was killed. Pedestrian accidents have the potential to result in catastrophic injuries such as brain trauma, spinal cord damage, fractures, internal organ damage, etc. Pedestrian accidents also often result in fatalities.
When these types of accidents are caused by drivers’ negligence (carelessness) — examples of which include impaired driving, distracted driving, and failing to yield the right of way to a pedestrian in a crosswalk, the victims can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
