Pedestrian Fatally Struck at Bronx Intersection

Lourdes Camilo, 53, was killed in a hit-and-run pedestrian accident in the Bronx after she was struck by two vehicles. According to a report in The Daily Mail, surveillance footage captured the horrific collision. NYPD officials said Camilo was waiting to cross the intersection of Melrose Avenue and 157th Street in the Bronx when she was struck by the first vehicle the night of Jan. 13. She was then thrust into the air and into the path of a second vehicle, which was traveling in the opposite direction at a considerable rate of speed, per the surveillance video, officials said.

Ongoing Fatal Crash Investigation

The first vehicle sped off after the moment of impact while the driver of the second vehicle, a 53-year-old man, remained at the scene. Police said Camilo lived just a few blocks from where the pedestrian accident occurred. The search for the driver of the white Jeep Grand Cherokee that struck and killed Camilo is still ongoing.

The driver of the second vehicle is not being charged, the Daily Mail reports. Officials said he cooperated with them at the scene. So far, the hit-and-run driver has not been arrested. The investigation is ongoing. We offer our deepest condolences to the family members of Lourdes Camilo for their tragic loss. They will remain in our thoughts and prayers.

New York Hit-and-Run Laws

In New York, a hit-and-run accident, where a driver leaves the scene without stopping or providing necessary information, is a serious offense. According to New York State law, drivers involved in an accident must stop and exchange information with the other parties involved. This information includes names, addresses, insurance details, and vehicle registration numbers. Failing to do so can result in criminal charges.

In cases where the accident causes injuries or death, leaving the scene can elevate the offense to a felony, carrying severe penalties such as fines, license suspension, and imprisonment. New York law emphasizes the duty of drivers to remain at the scene and report accidents promptly.

Compensation for Victims

In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused. Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. Our law firm recovered $2,000,000 (two million dollars) in a hit-and-run accident.

Victims and their families in such cases should retain an experienced personal injury lawyer right away to help protect their legal rights. A family who has lost a loved one in a hit-and-run crash can file a wrongful death lawsuit seeking compensation as well.

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
