A 60-year-old woman was critically injured in a Brooklyn pedestrian accident. According to a report on Audacy.com, the major injury crash occurred at the intersection of Flatbush Avenue and Fourth Avenue. An 81-year-old man was driving a yellow taxi south on Flatbush Avenue when he struck the woman who was crossing the street. Emergency personnel transported the injured pedestrian to an area hospital in critical condition. The taxicab driver remained at the scene. No charges have been filed pending an official investigation by the NYPD’s Highway District Collision Investigation Squad.
This incident came just a day after a 3-year-old girl was killed and her 2-year-old sister was hospitalized after being struck by an SUV while crossing the street with their mother in Harlem. Safety advocates with the group Transportation Alternatives told 1010 WINS that the city could be doing more to prevent these pedestrian accidents that result in major injuries and fatalities. According to the most recent NYPD data published on July 7, there has been a 5.6% increase in traffic deaths in 2024 when compared to last year, with 132 fatalities citywide. Our thoughts and prayers are with the injured pedestrian. We wish her a speedy and full recovery.
Rights of Pedestrians in New York City
In New York City, pedestrians have clear rights of way intended to ensure their safety on the streets. Under New York State Vehicle and Traffic Law, pedestrians have the right of way at marked crosswalks and in unmarked crosswalks at intersections. This means drivers must yield to pedestrians who are crossing the street in these designated areas. Additionally, pedestrians have the right of way when they are within the crosswalk and facing a green pedestrian signal or when the walk signal is displayed.
Drivers are also required to yield to pedestrians at driveways and alleys, and they must stop for pedestrians in the crosswalk even if the traffic light turns red for the pedestrian. If a pedestrian is injured due to a driver’s failure to yield, he or she can seek compensation for damages such as medical expenses and lost wages, etc. Pedestrians also have the right to be free from intimidation or harassment from drivers while crossing the street.
Injuries and Compensation
Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.
Pedestrian accident victims and their families should remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one-million-dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
